In Yal v. Minister of Forests, 2004 BCSC 1253, Halfyard J. appears to have assumed that s. 15(5) does extend that far. More recently, in Law Society of B.C. v. Dempsey, 2005 BCSC 1277, Williams J. appears to suggest that it does not.
