What is the difference between a discussion of matrimonial issues in 1790 and 1663?

Saskatchewan, Canada

The following excerpt is from Jones v. Jones, 1925 CanLII 98 (SK QB):

It is not only interesting to compare the attitude of approach to the discussion of subjects matrimonal in 1790 with that of 1663. There are many intermediate causes, until the next great decision in 1897. It has seemed to me not only interesting but necessary to determine my duty at this date to examine these intermediate decisions with some care, and pertinent to an appreciation of Russell v. Russell. I have, when on the subject, brought the examination down to date.
