Rule 9-6(4) provides that the court must dismiss a claim if it is satisfied that there is no bona fide issue for trial. To succeed under Rule 9-6, the applicant must establish that it is manifestly clear that no bona fide issue exists, with any doubt being resolved in favour of the plaintiff. In considering an application under Rule 9-6, the court may consider evidence, but it is generally not appropriate to assess credibility and weigh evidence: Jesson v. Wilkinson, 2018 BCSC 1921, paras. 16-18.
