What is the test for giving a spouse a gift?

British Columbia, Canada

The following excerpt is from Perry v. Marshall, 2001 BCSC 177 (CanLII):

This case was really about an inter vivos transaction, the creation of a joint bank account, and whether this resulted in a gift. I am unable to distinguish it from Romaine v. Romaine 2000 BCSC 1379, at paragraphs 16 and 17.
