I use the term “retroactive” in reference to the temporal operation of legislation in a narrow sense. Retroactive laws refer to legislation that deems the law to have been something different than it actually was as of a date that precedes the enactment of the law. Truly retroactive laws are rare and commonly target a specific situation with language aimed at addressing a very specific problem: see e.g. Air Canada v. British Columbia, 1989 CanLII 95 (SCC), [1989] 1 S.C.R. 1161.
