McTiernan J. followed Regina v. Keyn and found in it an answer to any territorial claim by a colony to such waters. At p. 36 of the judgment he stated: “The boundary limits of the colonies, read in the course of argument, do not satisfy me that the boundary of any colony was set in the high seas.”
