Sections 4 and 5 of the Family Law Act require determination of ownership and then a calculation which results in one spouse paying money to the other (see Rawluck v. Rawluck, 1990 Carswell Ont 217 (SCC)). In this case, deductions are requested with respect to gifts and inheritances pursuant to s. 4(2) of the Family Law Act. There are also issues as to the values of assets and debts as of the date of marriage.
