In conclusion, the majority judgment recognized the need for “a rule which will permit transference of benefits to third parties where appropriate, and at the same time avoid the double recovery of monies on account of lost earnings which general principle and the case law suggest is inappropriate”: Ratych v. Bloomer at 982.
