In R v. Z.R.[12], the offender received a sentence of 20 months of incarceration. When he came home at 04:00 o’clock in the morning, he wanted to have sexual intercourse with his spouse. She refused. He then threatened, tore off her underwear and penetrated her with his fingers. He was 45 years old, worked and had no criminal record. The risk of re-offence was low.
