In Basarsky v. Quintan, 1971 CanLII 5 (SCC), 24 D.L.R. (3d) 720, all facts giving rise to the action and the liability of the defendant therein had been pleaded in the original statement of claim and the defendant had examined for discovery on all matters relevant to the proposed amendment. An amendment was permitted in these circumstances.
