I am satisfied that the window and non-window claimants have been treated differently. The non-window claimants come under the enumerated head of “disability” under s. 15 of the Charter (Quebec v. Montreal (City), supra). Therefore, the non-window claimants are entitled to the s. 15 Charter protection.
