Documents are privileged when they involve: 1. a communication between a solicitor and client; 2. which includes the seeking or giving of legal advice; and 3. which is intended by the parties to be confidential: Pritchard v. Ontario (Human Rights Commission), 2004 SCC 31 at paras. 15 and 16.
