The defendant submits that an order should be made here such as was made by Sinclair J. in Price v. Labossiere ordering the plaintiff to request her doctors and physiotherapists to produce the said notes, records and X-rays. Counsel for the plaintiff submits that the present case is distinguishable from Price v. Labossiere because in the present case no independent medical report has been obtained by the defendant.
