28 Two years later, MacLennan J. came to the conclusion that costs could be recovered in Ponton v. The City of Winnipeg (1909), 1909 CanLII 47 (SCC), 41 S.C.R. 366. The difference was that the case was from Manitoba and there was a statute that bore on the subject.
