Is a plaintiff entitled to interim spousal support?

Ontario, Canada

The following excerpt is from Bourgon v. Paquette, 2004 CanLII 5924 (ON SC):

In November of 2002, the wife was involved in a motor vehicle accident, while driving a company car, in the course of her employment. She has been collecting Workmen’s Compensation benefits since the date of the accident. The husband questions her credibility in this regard and her ability to be self-supporting will be examined more closely at trial. For the present, she clearly is in need and the husband has the ability to pay interim spousal support. (See Plaxton v. Plaxton, [2002] O.J. No. 1226).
