Penalty for professional misconduct and conduct unbecoming should address a number of goals: specific deterrence, general deterrence, rehabilitation, restitution, and the maintenance of public confidence in the legal profession: Law Society of Ontario v. Fathi, 2021 ONLSTH 129 at para. 21, citing Law Society of Upper Canada v. Strug, 2008 ONLSHP 88.

Consideration of these goals is assisted by examination of the non-exclusive list of factors established in Law Society of Upper Canada v. Aguirre, 2007 ONLSHP 46, which we have considered.
