Madam Justice Rawlins went on in paragraph 30: “There is no suggesting that the mother is not a proper parent or that her role as primary care giver should change. Again as our Court of Appeal said in MacPhail v. Karasek “custodial parents should not be faced with the potential loss of custody simply because they chose to move nor should a decision to move be seen automatically as a negative factor in the ability to parent.”
