In Osman v. Heath, 2016 ONSC 4812, the court had to determine an adverse possession claim involving a large shed which straddled a property line. C. MacKinnon J. found that the true owner of the land, who was resisting a claim of adverse possession, had effectively abandoned it. Furthermore, there was evidence that the claimants and their predecessors in title had never acknowledged the right of possession of the true owner. In that case, the claim for adverse possession succeeded.
