41. In any event, as noted by Counsel for the Respondent, Ontario Courts have considered this practice and have recognized assessment companies to be the agent of the insurer - not the regulated health professional (see for example, Rintjema v. TO Home and Auto Insurance Company, 2018 ONSC 996).
