Here there was no expert evidence tendered, by either party, as to the cause of either the smell problem, or the pooling water problem. The absence of expert evidence is not always fatal to a claim of negligence (also see: Clements v. Clements, 2012 SCC 32), but a plaintiff must always prove causation to a balance of probabilities.
