In an early case in New Brunswick, Upton v. Pingree, 7 N.B.R. 186, the jury were directed that to render a tenant liable for the destruction by fire of the landlord’s buildings demised to him the defendant must be guilty of gross negligence, and on appeal this was held a proper direction.
