In Murchie v. Murchie, the husband owned a number of assets including a dental practice and some real estate investments before the marriage. After 12 years, these family assets were divided equally but the husband had good income-earning capacity as a leading practitioner in the well paid specialty of restorative dentistry. An unequal distribution in his favour would have been unfair having regard to the needs of each spouse to become or remain economically independent and self-sufficient.
