It is a general rule of municipal law that the power to make by-laws does not include a power to enact discriminatory provisions, unless the authorizing legislation provides to the contrary: see Montréal v. Arcade Amusements Inc., 1985 CanLII 97 (SCC), [1985] 1 S.C.R. 368.
