In Mulvihill v. Ottawa (City), 2008 ONCA 201 (CanLII), the trial judge awarded bad faith damages, in part because the City had terminated the plaintiff while she was on sick leave. The award of general damages was set aside on appeal, and Gillese J.A. stated:
