A motion to oppose confirmation is treated like an appeal: Moore v. John A. Annen Barrister Professional Corporation, 2017 ONSC 7720 at paragraph 11(o). In other words, the moving party must demonstrate that the Assessment Officer erred in law, made a palpable error of fact or made an error of principle in the exercise of his discretion.
