Mr. Justice Greyell recently provided an analysis related to lump sum spousal support awards in K.D.R.A. v. Y.J.A.A., 2014 BCSC 2310, relying on Madam Justice Watchuk’s canvass of the law in Robinson v. Robinson, 2011 BCSC 1489, aff’d 2012 BCCA 497. Judges are conferred broad discretion through s. 15.2(1) of the Divorce Act to make an award of periodic or lump sum spousal support, or to make an award comprised of both forms of support.
