To be a “court of competent jurisdiction”, a court must have jurisdiction over the subject matter, jurisdiction over the person and jurisdiction to grant the remedy sought. Mills v. The Queen 1986 CanLII 17 (SCC), 26 CCC (3d) 481 (SCC).
