Miglin v. Miglin, 2003 SCC 24 confirms that a fairly negotiated agreement that represents the intentions of the parties, and which substantially complies with the objectives of the Divorce Act, should receive considerable weight. On the other hand it is well settled that courts may review and reject the terms of a pre-existing agreement.
