The burden of proof rests with the injured person to establish that, on a balance of probabilities, her claims satisfy the threshold. Where the plaintiff fails to discharge the onus of bringing her alleged impairment within the statutory exception, her action for general damages and health care expenses must be dismissed: Meyer v. Bright, at pp. 27-28.
