In making a determinate order on a motion of no confidence in a motion for personal injury in a personal injury case, what are the reasons why such a determination is necessary?

British Columbia, Canada

The following excerpt is from Uram v. Uram, 1984 CanLII 593 (BC SC):

In making a determinate order I have considered the reasons of the majority in Messier v. Delage, supra. I do not read these reasons as preventing the making of a determinate order if the actual circumstances existing at the time of the trial require such an order. Rather they argue against making such an order on the basis of speculation.
