In my opinion, this appeal should be allowed, the judgment appealed from set aside, and there should be a declaration that s. 10 of The Workers' Compensation Act, as amended in 1974, does not bar the appellant's action. It follows that, in my opinion, McLean v. Bick was wrongly decided.
