I also conclude that the motion judge properly applied this court’s decision in McDougald Estate v. Gooderham on costs in estate matters and that he properly discounted the respondents’ offer to settle. Accordingly, on the respondents’ cross-appeal of the motion judge’s costs order, I would deny leave to appeal.
