In the Martin v. Martin, [2007] O.J. No. 467, Linhares de Sousa J. found unconscionability to support an unequal division of net family property. The learned judge took cognizance of the fact that the respondent had spent the majority of his earnings on his addictions and personal hobbies of golf and hockey, beggaring the family assets.
