The following excerpt is from Calgas Investments Ltd. v. 784688 Ontario Ltd. (Gen. Div.), 1991 CanLII 7119 (ON SC):

3. Therefore the applicant (client) has shown that there existed a previous relationship (as set out in MacDonald Estate v. Martin, supra) which is sufficiently related to the retainer from which it is sought to remove the solicitor. Therefore the court should infer that the confidential information was imparted unless the solicitor satisfies the court that no information was imparted which could be relevant.
