In considering privacy, Macaulay J. quoted LaForest J. in Canadian Broadcasting Corporation v. New Brunswick (Attorney General), supra. At para. 81, LaForest J. stated that “where the circumstances and the evidence support such concerns, ‘undue hardship on the persons involved’ may, in the interest of the proper administration of justice, amount to a legitimate reason to order exclusion.”
