The criteria to be considered on a motion for interim costs and disbursements is set out in Ludmer v. Ludmer. It is a four part test, the components of which are correctly summarized at paragraph 8 of the motions judge’s endorsement. The order is a discretionary one, and is granted in order to level the playing field where there appears to be very significant disparity in resources.
