Counsel for the Attorney-General also argued the application on the basis that the principles applicable to the granting of a "Mareva" injunction are applicable. Since I have decided the application upon a different exception to the ordinary rule in Lister v. Stubbs, I specifically refrain from passing upon the applicability of the "Mareva" principles to this case.
