The following excerpt is from T. v. L., 1988 CanLII 3438 (AB QB):

In Lindsay v. D.M. the patient sought disclosure of his medical records because of the assistance those records might be to him in litigation he was conducting against his wife and certain doctors relating to his confinement in another hospital. In Lindsay, the keeper of the records filed no material with the court. Accordingly, an argument by the keeper of records that disclosure was contrary to the medical interests of the applicant failed for lack of evidence.
