In Letvad v. Fenwick, 2000 BCCA 630, 82 B.C.L.R (3d) 296, a plaintiff who had undergone surgery in 1993 brought a claim in negligence against his surgeon and the hospital where his surgery was performed. In June of 1999, four months before the scheduled trial date, the plaintiff applied to add two further physicians as defendants. He also sought to amend his pleadings against the defendant hospital to raise what were said by the hospital to be new causes of action.
