In a recent family law case, Abdiwahab v. Mohamuud, [2013] O.J. No. 4482 (S.C.J.), at para. 44, Justice Croll, in following the cases outlined above, held that the Legal Aid rates were not determinative of the costs award and that costs should be awarded as they would have been had there been no Legal Aid certificate.
