Leave to amend should be refused where there is no reason to believe that the party’s case could be improved by an amendment. “[I]f it is clear that the plaintiff cannot allege further facts that they know to be true to support the allegations in the pleading, leave to amend will not be granted”: [Miguna v. Ontario, para. 18].
