The Landlords bear the responsibility of proving its claims and the alleged damages on the legal standard known as a “balance of probabilities” (see Hamilton v. Turner, 2018 SKQB 140 (CanLII)). This means that the claimant must prove with clear, convincing and cogent evidence the merits of its claim and the amount of any damages.
