The parties referred the court to the decision of Madam Justice Rowles in Laird v. Lyne Estate, 2005 BCCA 437, both parties taking solace from its findings. The applicant relied on the fact that Madam Justice Rowles did not follow what is accepted as long-standing authority in this court which she refers to in para. 30 of her decision as follows:
