The plaintiff submits that he is entitled to pre-judgment interest on the Kuwait Debt Judgment pursuant to s. 1 of the COIA. Pursuant to s. 1, “the amount ordered to be paid” is calculated on the amount the plaintiff is determined to be entitled to and not the balance owing at the time of trial: Nicholls v. Richmond, 1985 CanLII 366 at para. 22 –36.
