In Khangura v. Rogalski, 2017 BCSC 1753 at para. 26, Fleming J. stated as follows regarding the issue of identifying the statutory basis of a previous order:

Although the test for variation of a final order is materially the same under both statutes, the question remains: which provision applies to the respondent's application to vary the terms of the 2013 Order regarding his parenting time, communication, and family dispute resolution? The meaning of a court order, including its statutory foundation, is determined by the objective indicia found in the pleadings, the wording of the order, and the circumstances in which it was made. In the absence of objective indicia, the doctrine of paramountcy will apply and the order will be "founded" in the federal legislation: Yu v. Jordan, 2012 BCCA 367, at para. 1.
