The following excerpt is from Carson v. University of Saskatchewan (Joint Senate-Council Board of Student Appeals), 2000 SKQB 322 (CanLII):

I do not perceive that Khan v. University of Ottawa, supra, pronounces that there is only one exception to the general rule, that exception being where credibility of the student is relevant. I perceive the appropriate state of the law to be that each individual circumstance must be examined upon its own facts and merits to determine whether special circumstances arise such as to be considered a reasonable exception to the general principle.
