In Kennedy v. De Trafford [1897] A.C. 180, 66 L.J. Ch. 413, the headnote in part reads as follows: There is no relationship of trust or agency in one co-owner of a property towards the other; and where one collects the rents of the whole he does so not in the capacity of agent, but in that of owner.
