Ultimately, the decision is one for the discretion of the presider having considered the various factors relevant to the case before them with the above listed factors being non-exhaustive. The onus is on the applicant to show that the factors support that such an order is either necessary or expedient, and if they cannot meet that onus, then the status quo should prevail: Kapoor v. Makkar, 2020 BCCA 223 (“Kapoor”) at para. 23.
