In Jordan v. Jordan, 2016 BCSC 1354, the payee spouse’s evidence of her alleged disability causing her to be unemployable was found to be deceptive, leading to a finding that she was somewhat employable. This was not determinative of the outcome. Rather the material change in circumstances arose out of the payor’s physical and mental limitations that limited his means to pay spousal support. Therefore spousal support was terminated: at paras. 59, 71, 75, 84.
