Issue 1 What is the appropriate standard of review? A standard of review analysis need not be conducted in every case. Where the standard of review applicable to a particular issue before the court is determined in a satisfactory manner by previous jurisprudence, the reviewing court may adopt that standard of review (see Dunsmuir v. New Brunswick, 2008 SCC 9, [2008] 1 S.C.R. 190,at paragraph 57).
